Petition Demanding a Defender of the Constitution
To President George W. Bush:
In appointing members of the Judicial Branch of the Federal Government, you will have a lasting impact on the direction of this nation, the health of our republic, and the liberty of her people. This is especially true of appointments to the highest court in the land, the Supreme Court.
With the recent resignation of Justice Sandra Day O'Connor, you have a unique opportunity to appoint a jurist who will defend the Constitution and the original intent of the Founders of this great nation. You have a duty to replace a Justice whose views were guided by whim with a Justice who will be guided by a principled understanding of the Constitution.
We, the undersigned citizens of this great nation, hereby demand that you select a Supreme Court nominee who satisfies the following ten criteria:
1. The nominee shall know that the powers of Government must be bound by the chains of the Constitution, restricting its powers to those clearly enumerated therein, and that all other activities are unconstitutional.
2. The nominee shall respect the rights and sovereignty of the several states that comprise our Union.
3. The nominee shall be chosen based solely on merit and ability, and not to fulfill an affirmative action agenda or reward personal friendships.
4. The nominee shall ensure equality before the law in protecting those rights granted by the Creator, including but not limited to the rights to life, liberty, and the pursuit of happiness.
5. The nominee shall recognize that no precedent should ever supersede a clear reading of the Constitution, and any such conflicting decision must be expunged and the original intent of the Framers restored.
6. The nominee shall commit to uphold the separation of powers and to defend the Constitutional roles of the Legislative and Executive Branches from usurpation and tyranny by the Judiciary.
7. The nominee shall understand that the Constitution may only be amended through the proper constitutional process, and shall reject attempts to do so by judicial fiat, legislation from the bench, the discovery of penumbra, or other Orwellian word games that change the original meaning of the Constitution.
8. The nominee shall understand that "freedom from religion" negates the freedom of religion guaranteed by the First Amendment, which was meant by the Framers to limit Congress only, and not the states or the people in their expressions of faith.
9. The nominee shall reject the current fashion among Supreme Court Justices of applying foreign law as though it were superior to the Constitution.
10. The nominee shall be obligated to uphold the Constitution as written without regard to political considerations, expediency, legacy, or personal opinion.
